Partner Visas – Live in Australia with Your Loved One

Australian Citizens, Permanent Residents, or Eligible New Zealand Citizens can
sponsor their partner to live in Australia. This includes spouses, fiancé(e)s, de
facto partners, and same-sex partners. Partner visas are designed to keep
families together and provide a pathway to permanent residency.

Types of Partner Visas

Prospective Marriage Visa (Subclass 300)

For applicants outside Australia who are engaged to an eligible Australian
sponsor. Applicant must commit to marry the Australian sponsor within nine
months of arriving in Australia.

Partner Visa (Subclass 820/801)

820/801) – Onshore Pathway
For applicants already in Australia who are married to or in a de facto
relationship with their sponsor.
> Subclass 820: Temporary visa valid for 2 years.
> Subclass 801: Permanent visa, granted after the relationship is assessed
as genuine and ongoing.

Partner Visa (Subclass 309/100)

309/100) – Offshore Pathway
For applicants outside Australia at the time of application.
> Subclass 309: Temporary visa.
> Subclass 100: Permanent visa after eligibility is met.

Parent Visas

2-year temporary visa that can lead to the permanent 143 visa.

Aged Parent Visa (Subclass 804)

Permanent visa for parents aged 65+ applying onshore. Low cost but
very long wait times (up to 30 years).

Contributory Aged Parent Visa (Subclass 864) / Temporary (Subclass
884)

For parents aged 65+ applying onshore. Faster pathway compared to
804. The 884 is a 2-year temporary visa leading to the permanent 864.

Child Visas

Australian Citizens, Permanent Residents, or Eligible New Zealand Citizens can
sponsor their children, adopted children, orphan relatives, or dependent
children to live in Australia permanently.

Visa Options

Child Visa (Subclass 101/802)

For biological, adopted, or step-children.

Orphan Relative Visa (Subclass 117/837)

For children under 18 whose parents have passed away, cannot care for
them, or are missing. The sponsor must be an Australian citizen, a
Permanent resident, or an Eligible New Zealand citizen who relates to
the visa applicant(s).

Dependent Child Visa (Subclass 445)

For children of parents holding a temporary Partner Visa (Subclass 820
or 309).
o Allows the child to stay in Australia until the parent is granted a
permanent Partner Visa (Subclass 801 or 100).
o Must be lodged before the parent’s permanent visa decision.
